1. Agreement
By accessing or using Tackmark (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these terms.
2. Description of Service
Tackmark is a go-to-market intelligence platform that monitors publicly available competitive, buyer, and market signals and delivers a synthesized intelligence brief. The Service includes a web application, background data collection, AI-powered analysis, and email delivery.
3. Acceptable use
You may use the Service only for lawful purposes. You agree not to:
- Resell, sublicense, or redistribute the Service or its outputs without written permission
- Use the Service to collect or infer non-public personal data about individuals
- Attempt to reverse-engineer, scrape, or otherwise extract underlying data or algorithms
- Use the Service in a way that violates any applicable law or regulation
- Interfere with the security, integrity, or availability of the Service
4. Intellectual property
All software, design, and technology underlying Tackmark is owned by Tackmark and its licensors. The intelligence outputs generated for your account are licensed to you for internal business use only. You retain ownership of any data you provide to configure the Service (competitor lists, buyer lists, configuration).
5. Data and privacy
Our handling of your data is described in the Privacy Policy, which is incorporated into these Terms by reference.
6. Disclaimers and limitation of liability
The Service is provided “as is.” Tackmark makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for purpose of any intelligence output. Market intelligence is inherently uncertain — outputs should be one input to your decision-making, not the sole basis for material business decisions.
To the maximum extent permitted by applicable law, Tackmark's aggregate liability for any claims arising out of or related to the Service shall not exceed the fees you paid in the twelve months preceding the claim.
7. Early access
The Service is currently offered in early access. Features may change or be discontinued. Tackmark reserves the right to modify pricing and terms with 30 days' notice before early access concludes.
8. Termination
Either party may terminate the Service relationship at any time. You may request deletion of your data at any time by emailing hello@tackmark.com. Tackmark may suspend or terminate accounts that violate these terms.
9. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflicts of law principles. Disputes shall be resolved in the courts of Wake County, North Carolina.
